This research brief analyzes banned/no trespass lists on college campuses. Specifically, we investigate the creation, content, and distribution of internal banned/no trespass lists. We also examine legal constraints and liability concerns associated with maintaining and distributing banned/ no trespass lists.
Key observations from our research
1. Rather than maintain a consolidated list of individuals from campus, campus security logs banned individuals’ basic information in a record management system.
2. Campus security at most profiled institutions distributes information about banned individuals on a case-by-case basis, while campus security at one institution shares this information on the institution’s website.
3. Contacts do not report encountering legal issues in the creation and distribution of banned lists, which many attribute to the private nature of their records on banned individuals.
4. The U.S. Department of Education states that the release of directory information is not a violation of FERPA.
